2. Acceptance of Terms
Thank you for visiting Freshokit. These Terms of Use (“Terms”) explain your rights and responsibilities when accessing or using the Freshokit website at www.freshokit.com, any related mobile or software applications, and any other services or features made available through these platforms (collectively, the “Services”).
These Terms apply to all existing and future Freshokit customers and users. By accessing or using the website or marketplace (the “Marketplace”), you acknowledge that you have read, understood, and agreed to these Terms. This agreement between you and the Company is referred to as the “User Agreement.”
If you do not agree to these Terms, or are unable to be legally bound by them, you must not access or use the Services.
You use the Freshokit Platform at your own risk. This includes the possibility of encountering content that you may consider objectionable or inappropriate.
This document is published with reference to Rule 3 of the Information Technology (Intermediaries Guidelines) Rules, 2011, as stated in the original policy. The Company reserves the right to update the User Agreement from time to time without prior notice. Users are therefore encouraged to review these Terms whenever they access or use the Marketplace.
Throughout these Terms, the words “visitor,” “user,” “you,” and “your” refer to anyone who visits, accesses, browses, or uses the Marketplace.

3. Overview of Services
The Marketplace provides a platform through which domestic consumers can transact with third-party sellers who have been granted access to display and offer products for sale.
The Company's role is to provide the Marketplace as a platform for transactions. Unless expressly stated otherwise in writing, the Company does not provide additional services to users beyond those specifically communicated by the Company.
The Company is not a party to transactions between users and third-party sellers and does not control or influence the products offered by those sellers or the prices they charge. The Company disclaims warranties and liabilities relating to products offered by third-party sellers, to the extent stated in these Terms and permitted by applicable law.
Marketplace services are available only in selected geographical areas within India. Availability may also depend on the operating hours and days of the relevant third-party sellers and any applicable service restrictions.
Delivery Charges
Orders may be subject to delivery charges if the applicable minimum order value is not met. Any applicable delivery charges will be displayed at checkout before the transaction is completed.
Convenience and Safety Fees
Transactions through the Marketplace may also be subject to convenience fees or safety fees. If applicable, these fees will be communicated to you at checkout before you complete your purchase.
4. Eligibility
Individuals who are legally incompetent to enter into a contract under the Indian Contract Act, 1872, including minors and undischarged insolvents, are not independently eligible to use or access the Marketplace.
Individuals under the age of 18 may access or use the Marketplace only under the supervision of a parent or legal guardian who agrees to be bound by these Terms. Minors are prohibited from purchasing products intended for adult consumption where the sale of such products to minors is prohibited by law.
The Marketplace is intended for end consumers purchasing products for personal or domestic consumption. Retailers, institutions, wholesalers, and other business users are not eligible to purchase products from third-party sellers through the Marketplace under these Terms.
Refusal or Termination of Access
The Company reserves the right, at its discretion and without liability to the extent permitted by law, to terminate or refuse registration or access to the Marketplace if:

A user does not meet the eligibility criteria.

The Company has reasonable grounds to believe, including on the basis of usage patterns, that a user does not meet or has violated the eligibility criteria.

A user may be in breach of these Terms or the User Agreement.
To assess compliance, the Company may use algorithms, technology, and predetermined criteria. Access to an account may be restricted or blocked where usage patterns match such criteria.

5. Licence and Access
The Company grants users a limited, non-exclusive, non-transferable licence to access and make personal use of the Marketplace, subject to these Terms.
Unless expressly permitted by the Company in writing, users may not download content other than through ordinary page caching, modify the Marketplace or any part of it, or use the Marketplace for resale or commercial purposes.
This limited licence does not permit:

Reselling or commercially exploiting the Marketplace or its content.

Collecting or using product listings, descriptions, or prices for unauthorised purposes.

Making derivative use of the Marketplace or its content.

Downloading or copying information for the benefit of another third party.

Using data-mining tools, robots, or similar methods to collect or extract data.
You may not use framing techniques to enclose any trademark, logo, or other proprietary information of the Marketplace, the Company, or its affiliates—including images, text, page layouts, and forms—without prior written permission.
You may not use meta tags or other hidden text containing the Company's name or trademarks without prior written permission.
You must not attempt to gain unauthorised access to any part of the Marketplace, its features, connected systems or networks, servers, computers, or services through hacking, password mining, or any other illegitimate means.
Prohibited Content and Activities
You agree not to host, display, upload, modify, publish, transmit, update, or share information that:

Belongs to another person and that you do not have the right to use or share.

Is grossly harmful, harassing, profane, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another person's privacy, hateful, racially or ethnically objectionable, disparaging, or otherwise unlawful.

Relates to or encourages money laundering or gambling in a manner prohibited by law.

Harms minors in any way.

Infringes patents, trademarks, copyrights, or other proprietary or intellectual property rights.

Violates any law currently in force.

Misleads recipients about the origin of a message or communicates information that is grossly offensive or menacing.

Contains software viruses or other code, files, or programmes intended to interrupt, destroy, or limit the functionality of computer resources.

Threatens the unity, integrity, defence, sovereignty, or security of India; harms friendly relations with foreign states or public order; incites the commission of a cognisable offence; obstructs the investigation of an offence; or insults another nation.
You must not submit information that is misleading or that you know to be false.
Any unauthorised use may result in the automatic termination of the permission or licence granted by the Company, subject to applicable law.
6. Account and Registration Obligations
Users must register and log in to place orders through the Marketplace.
You are responsible for keeping your account and registration details accurate, complete, and up to date, including all contact information needed for communications relating to your purchases.
By accepting these Terms, you agree to receive promotional and transactional communications, including newsletters, from the Company and its partners, as described in the applicable policies. You may opt out of promotional communications or newsletters by contacting customer service or submitting an appropriate request through the available channels. Transactional communications relating to your orders may still be necessary.
Information Collected During Registration
As part of the registration process, the Company may collect personally identifiable information, including but not limited to:

7. Pricing and Product Availability
The Company endeavours to ensure that product prices displayed on the Marketplace are accurate. However, prices or product information may occasionally be incorrect or out of date because of technical issues, typographical errors, or incorrect information supplied by third-party sellers.
In such circumstances, the Company reserves the right to cancel an order, subject to applicable law and without further liability to the extent permitted by law.
Subject to the above, the price displayed when an order is placed will be the price charged at the time of delivery, provided that no product offered for sale through the Marketplace will be sold at a price higher than its applicable maximum retail price (MRP).
The Company does not guarantee that every product displayed on the Marketplace will always be available. The display of a product does not necessarily constitute an endorsement of its sale or purchase.
The Company disclaims liability for errors, inaccuracies, or omissions in information provided by third parties, to the extent permitted by applicable law.
You acknowledge that the Company does not acquire ownership, title, or interest in products that are the subject of a sale and purchase contract between you and the relevant third-party seller.
The Company does not control product quality, the fulfilment of third-party sellers' obligations, or other aspects of products supplied by them. Subject to applicable law, the Company is not responsible for damages or delays arising from products that are out of stock, unavailable, or on back order.
8. Reviews, Feedback, and Submissions
Reviews, comments, feedback, suggestions, ideas, and other submissions that you disclose, submit, or offer through the Marketplace or in connection with your use of it are referred to as “Comments.”
Under these Terms, such Comments will be treated as the Company's property, subject to applicable law and any rights that cannot legally be assigned.
By submitting Comments, you agree to assign to the Company the worldwide rights, title, and interest in the copyrights and other intellectual property rights associated with those Comments, to the extent legally permissible.
The Company may use, reproduce, disclose, modify, adapt, create derivative works from, publish, display, and distribute submitted Comments for any purpose, without restriction or compensation, subject to applicable law.
The Company's Obligations Regarding Comments
The Company is not obligated to:

Pay compensation for Comments.

Maintain Comments in confidence.
You agree that any Comments you submit will not violate these Terms or infringe the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights. You also agree not to submit Comments that cause injury to any individual or entity.
You further agree that Comments submitted through the Marketplace will not contain libellous, unlawful, threatening, abusive, or obscene material; software viruses; political campaigning; commercial solicitation; chain letters; unsolicited emails; or any form of spam.
The Company reserves the right to monitor, edit, or remove Comments submitted through the Marketplace, subject to applicable law.
You grant the Company permission to use the name you provide in connection with your Comments, subject to applicable law.
You must not use a false email address, impersonate another person or entity, or otherwise mislead others about the origin of your Comments.
You remain responsible for the content of all Comments you submit. You also agree to indemnify the Company and its affiliates against claims, losses, and liabilities arising from your submitted Comments, to the extent permitted by applicable law.
